Divorce

When you come to the law firm of Surovell Isaacs & Levy PLC for representation during your divorce, we will focus our attention on you. Our experienced attorneys will never let you feel as though you have been lost in the shuffle. Instead, you will get personal attention from the start of your case to the finish.

This is extremely important, because every divorce case is different. Personal attention means that we can focus on the unique aspects of your divorce and customize a strategy to meet your needs. We provide solid guidance through all aspects of divorce, including:

  • Child custody and visitation — Legal and physical custody is determined and modified based on the best interests of the child or children
  • Child support — Child support guidelines are established to ensure child support obligations are fair, but deviations may be made under certain circumstances
  • Spousal support, also known as alimony — Support may be ordered by the court, considering the need and the earning ability of each spouse
  • Property division — If necessary, the court will determine the value and disposition of marital property

An Important Decision: Fault or No-Fault Divorce

In Virginia, a divorce can be granted on either fault or no-fault grounds:

  • Fault means that one spouse's wrongdoing has brought about the divorce. This wrongdoing could be adultery, desertion, cruelty or a felony conviction with confinement for more than one year.
  • No fault means that neither party is to blame for the divorce, as far as the legal process goes.

Determining whether or not to assert marital fault against your spouse can have an impact on the divorce process. For example, adultery could be the cause for an immediate final decree of divorce, while no-fault may require a six-month separation before the divorce can be finalized. Our lawyers can help you determine which path makes the most sense for you.
